Terms for businesses that use us

The short version
- We answer messages, take orders and keep records on your behalf. You stay in charge of your business and what it promises.
- Nothing is posted in your name without your OK.
- You can leave at any time, and your records are yours.
1. Who these terms are between
These terms are between James Thomas Banner trading as Simply Agentic, ABN 27 660 802 132 ("we") and the business that uses the service ("you"). If you message a business that uses us, you are that business's customer and our privacy policy applies to you.
2. What the service does
- Receives messages, texts and missed calls sent to your business and answers them on your behalf.
- Reads orders and bookings, reads them back to the customer, and shows them in your back office.
- Drafts posts, invoices and replies for you to approve.
What is switched on for your business is what we agreed with you in writing.
3. What you agree to
- Your accounts are yours. You connect only a Facebook Page, Instagram account, phone number or mailbox that you own or are allowed to manage.
- Your details are right. Your menu, prices, opening hours and other details are correct, and you tell us when they change.
- You follow the rules of the platforms. That includes Meta's terms for Pages, Messenger and Instagram.
- You look after your customers' information and use it only to serve them.
- You check the back office. Some things are always passed to a person: an allergy, an item not on the menu, a large order, an urgent or dangerous job.
- You do not use the service to send spam, to mislead people, or for anything unlawful.
4. AI and mistakes
The service uses AI to read what customers write. It can misread. We build in checks: prices come from your own menu, orders are read back to the customer before they are accepted, and anything unclear goes to a person. You remain responsible for what your business sells and promises.
5. Your approval
Nothing is posted to your Facebook Page or Instagram account without your OK. No email is sent in your name without your OK.
6. Your records
Your records and your customers' conversations belong to your business. We use them only to provide the service. You can ask for a copy at any time.
7. Fees
Fees are as agreed with you in writing before the service starts.
8. If something goes wrong
We work to keep the service running, but we rely on other companies (such as Meta, phone carriers and our hosting provider), and it will sometimes be unavailable.
Nothing in these terms takes away rights you have under the Australian Consumer Law. Where the law allows us to limit what we owe you for a fault in the service, it is limited to supplying the service again or refunding what you paid for the period affected.
9. Leaving
You can stop at any time by telling us in writing. We can stop providing the service if these terms are broken, or with 30 days' notice. When the service ends we disconnect your accounts, give you a copy of your records if you ask, and delete what we hold as set out in the data deletion page.
10. Changes
If we change these terms we will tell you at least 30 days before the change applies.
11. Law
These terms are governed by the law of New South Wales, Australia.
